GENERAL TERMS AND CONDITIONS

1. Area of Application

The following General Terms and Conditions govern the contractual relationship between the legal guardians of the children participating in the kidz-in-motion vacation camps and kidz-in-motion GmbH. 

 

 

2. Participation Requirements:

All children born in the years 2017 to 2010 who are physically healthy and resilient for such a sports camp from the point of view of their legal guardians are eligible to participate in kidz-in-motion camps 2023. Should health concerns be expressed by the responsible people of the kidz-in-motion GmbH, participation can be excluded. Allergies, food intolerances, illnesses and restrictions of the children must be communicated at the time of registration before the start of the camp.

 

 

3. Registration / Payment:

The participation fee in the calendar year 2023 is 225.00 euros per child and week including the statutory VAT of 19%. Registration takes place via online registration form on the homepage www.kidz-in-motion.de. This form must be completed by a parent or legal guardian of the child to be registered. After receipt of payment, the registration is legally valid even without an original signature. When registering, the e-mail address provided will be stored for the purpose of registering for the kidz-in-motion newsletter.

 

After submitting the online registration, the parent or guardian will receive a confirmation within 2 days to the e-mail address specified in the registration. This confirmation leads to a valid contract. The camp fee (or the reduced parental contribution in the case of employer subsidies) is due within 10 working days of registration and must be transferred to the account specified in the e-mail.

 

If the registration takes place up to 4 weeks before the start of the camp, the participation fee is to be transferred within 5 working days. If the participation fee is not transferred within this period, kidz-in-motion reserves the right to give the camp place to another child after the deadline. In this case, a handling fee of 30,00 Euro including VAT will be charged.

 

After payment the legal guardian will receive a payment receipt via e-mail within approx. two weeks. This payment receipt can also serve as a tax receipt.

 

 

4. Cancellation by Parent or Guardian:

• If a registration is cancelled that has not yet been paid, a processing fee of 30,00 Euro will be charged.
• If an already paid registration is cancelled up to 8 weeks before the start of the camp, a refund of 150,00 Euro will be made.
• If an already paid registration is cancelled up to 2 weeks before the start of the camp, a refund of 100,00 Euro will be made.
• If an already paid registration is cancelled later than one week before the start of the camp, a refund of the camp fee is not possible.

For employees of cooperating companies who receive an employer subsidy, the same cancellation conditions apply; the costs incurred are to be paid by the legal guardians of the registered child. The employer does not bear any cancellation costs.

 

If a registered child cannot attend the camp due to illness, a medical certificate must be submitted. Afterwards, the payment made will be refunded minus a 30,00 Euro processing fee. Cancellation due to illness must be communicated to the organizer at least 48 hours before the start of the camp. In case of later cancellations no refund is possible.

 

All amounts mentioned include 19% sales tax.

 

 

5. Arrival and Departure:

Transportation to and from camp is your and the child's own responsibility. kidz-in-motion is not obliged to inform the legal guardians if a child does not show up for the camp.

 

If the child is allowed to leave the camp independently and unaccompanied, the legal guardians must give permission for this in advance. This is done in the online registration form or will be communicated in writing on site.

 

 

6. Camp Exclusion:

A child may be expelled from camp for gross unsportsmanlike and antisocial behavior. This includes, but is not limited to, violence against other children, continuous disruption, repeated, undisciplined behavior, or willful destruction of camp property. A refund of the participation fee is not possible in case of camp exclusion.

 

 

7. Cancellation by kidz-in-motion:

The kidz-in-motion GmbH reserves the right to cancel individual camps if less than 15 participants are registered. If the implementation of the vacation camps is not possible due to force majeure (e.g. severe weather or pandemic) or for other organizational or economic reasons (e.g. due to illness of the trainers/supervisors), kidz-in-motion is entitled to cancel the vacation camp. The legal guardians will be informed immediately. In these cases, the participation fee will be refunded in full. Further claims, in particular the reimbursement of travel, food and accommodation costs as well as loss of work, are excluded.

 

 

8. Non-utilization of Services:

If the child does not take part in the camp week or does not take part completely, although the kidz-in-motion GmbH is able to fulfil the contract, there is no claim for refund of the participation fee.

 

 

9. Disclaimer:

• The kidz-in-motion GmbH excludes any liability for itself, its legal representatives and vicarious agents. Excluded from this exclusion of liability are the liability for damages resulting from injury to life, body or health and the liability from intentional or grossly negligent breaches of duty.
• There is no liability for damage to property and health during the journey as well as during the camp.

• The kidz-in-motion GmbH is not liable for all external services (catering, events, program components, public transport and bus and train rides, etc.).

 

10. Insurances: 

Occurring injuries or illnesses of the participants are covered by their own health insurance! Prerequisite for participation in the camp is an own health insurance.

 

The kidz-in-motion GmbH recommends all parents of participating children to take out a private liability insurance and a private accident insurance!

 

 

11. Photos and Publications:

On the registration form the legal guardians can agree to the publication of photos. The kidz-in-motion GmbH may take and process photos of their child with consent and publish these photos on the website and on promotional materials such as flyers, the Youtube channel, XING, Linkedin and on Instagram and on the Facebook page of the kidz-in-motion GmbH as well as press and media articles. the kidz-in-motion GmbH assures sensitivity and mindfulness in the use and publication of photos in which participating children are shown. The kidz-in-motion GmbH will not mention any names and will carefully ensure that the images protect the dignity and personal rights of the depicted people. This also applies to photos taken of participants during family&friends afternoons.

 

 

12. Newsletter: 

With the online registration I agree that the kidz-in-motion GmbH may use my e-mail address to send me e-mail newsletters with further information about the  camps. I am aware that the newsletter will be sent in accordance with the privacy policy data protection (Datenschutzerklärung). I know that my consent is voluntary and I can revoke it at any time by simple declaration (by e-mail to ferien@kidz-in-motion.de or by mail to kidz-in-motion GmbH, Köhlbrandtreppe 1, 22767 Hamburg), by clicking on the unsubscribe link in each newsletter or here link to unsubscribe for the future.

 

 

13. Copyrights:

The documents of kidz-in-motion are protected by copyright. The kidz-in-motion GmbH provides the summer camp documents to the participants only for the intended use.

 

 

14. Privacy Policy / Protection of Data:

The privacy policy data protection (Datenschutzerklärung) of the kidz-in-motion GmbH applies.

 

 

15. Final Provisions:

Should any provision of the General Terms and Conditions be invalid, this shall not affect the validity of the other provisions. In place of the invalid provision, a valid provision that comes as close as possible to it shall be deemed agreed. Deviating agreements or ancillary agreements must be stipulated in writing. The place of performance and jurisdiction is the registered office in Hamburg. The local jurisdiction of the court in Hamburg is agreed as the place of jurisdiction, insofar as this is legally permissible.
